Consultation has concluded

Queanbeyan-Palerang Regional Council has recently undertaken a number of administrative amendments to the Braidwood Development Control Plan (BDCP) 2006 and the Palerang Development Control Plan (PDCP) 2015.

The amendments to both the BDCP 2006 and the PDCP 2015 are to clarify that the BDCP 2006 will now wholly apply to the State-listed area of Braidwood, while the PDCP 2015 will apply to the remainder of the former Palerang Local Government Area (LGA).

In order to readopt the BDCP 2006, and for it to have the correct intended effect, a number of changes were required to be made to both the BDCP 2006 and the PDCP 2015. These changes are set out below:

Braidwood DCP 2006

  1. Updating both the front cover page and amendment table,
  2. Updating references from ‘Tallaganda Local Environmental Plan 1991’ to ‘Palerang Local Environmental Plan 2014’ and deleting reference to Braidwood Development Control Plan 2006 as a ‘repealed’ development control plan,
  3. Replacing outdated section numbers of the Environmental Planning and Assessment Act 1979 with the new updated numbers,
  4. Updating Map 1 to confirm the land to which BDCP 2006 is intended to apply,
  5. Deleting the Precinct description for the Residential Area West of Ryrie Street and transferring these provisions into the PDCP 2015 as this land is not part of the State listed heritage area and it is intended that the PDCP 2015 will apply to this land,
  6. Deleting the character statement for Mt Gillamatong. This is not part of the State-listed heritage area and it is intended that PDCP 2015 will apply to this land, and
  7. Updating the reference to the new Braidwood Flood Risk Management Study which was adopted in 2019, replacing the existing reference to a 2005 study.

Palerang DCP 2015

  1. Updating the Amendment Table
  2. Updating statement regarding land covered by the Development Control Plan (DCP) – reworded to clarify where the PDCP 2015 applies and where the BDCP 2006 applies (including deleting the statement that the PDCP 2015 repeals the BDCP 2006),
  3. Updating a number of sections to clarify that the DCP applies to the remainder of the former Palerang LGA whilst BDCP 2006 only applies to the State listed heritage area of Braidwood,
  4. Adding a section from the BDCP 2006 in respect of the area west of Ryrie Street.

Additionally further policy changes were also adopted in the PDCP 2015 by Council on 9 September 2020 and included:

  1. Updating the applicable tree and vegetation controls, and
  2. Adding a new character statement for North Elmslea near Bungendore.

These additional matters are also proposed to be bought forward as part of these amendments.
