In October 2025, Council initiated split zone subdivision planning proposal, seeking to amend the Queanbeyan-Palerang Regional Local Environmental Plan 2022 (QPRLEP 2022).

On 26 November 2025, Council endorsed to forward the Planning Proposal to the NSW Department of Planning, Housing and Infrastructure (DPHI) seeking a Gateway determination.

The DPHI has issued a Gateway determination advising Council to proceed with further assessment of the Planning Proposal, including public consultation.

Proposed amendments

The planning proposal seeks to introduce the following local clause into QPRLEP 2022 to allow subdivision of lots affected by multiple zones, where subdivision is currently prohibited under Clause 4.1 and cannot be exempted through Clause 4.6.

Draft Clause 4.1F Minimum subdivision lot sizes for certain split zones

1. The objectives of this clause are as follows –

  • To provide for the subdivision of lots that are within more than one zone but cannot be subdivided under clause 4.1,
  • To ensure that the subdivision promotes suitable land use and development,
  • To ensure that the subdivision protects the environmental and heritage attributes of the land.

2. This clause applies to each lot (an original lot) that contains –

  • Land in a residential, employment, mixed-use or RU5 village zone, and
  • Land in a C2 Environmental Conservation, C3 Environmental Management, C4 Environmental Living, RU1 Primary Production, RU2 Rural Landscape or RU3 Forestry zone.

3. Despite clause 4.1, development consent may be granted to subdivide an original lot to create other lots (the resulting lots) if –

  • One of the resulting lots will contain –
    • Land in residential, employment, mixed-use or RU5 Village zones that have an area that is not less than the minimum size shown on the lot size map in relation to that land, and
    • All of the land in Zone C2 Environmental Conservation, C3 Environmental Management, C4 Environmental Living, RU1 Primary Production, RU2 Rural Landscape or RU3 Forestry that was in the original lot, and
  • All other resulting lots will contain land that has an area that is not less than the minimum size shown on the lot size map in relation to that land.

4. A dwelling cannot be erected on a resulting lot referred to in the above 4.1F(3)(ii).
