Consultation has concluded

We are proposing to create a new $500 fee titled “Property Information Package” as part of a sale of a property.

The proposed fee is based upon feedback from frequent applicants (conveyancers, solicitors, real estate agents) that we could commit to a faster turnaround time. Application numbers are not likely to drop off given the weight of importance placed on this information from banks and also as part of buyer due diligence. Most applicants then pass on costs/disbursements to clients as part of the sale process. This fee is not intended to be imposed on current homeowners who wish to obtain information outside a sale process.

To assist with reducing processing times, Council will look to employ a second Access to Information Officer following the implementation of the fee. On average, the turnaround time for such requests is 4-6 weeks given the volume of applications received. With the implementation of the new fee, and an additional resource, staff are looking to be able to commit to a 10 working day turnaround time frame.

What does the new fee cover?

This fee provides applicants with a complete approval history on a property. This often requires extensive research into historical records and approvals from former Council entities. It provides access to all Consents, Building Information Certificates, Occupation Certificates, plans and reports (pending Copyright consent). Further advice as to how to deal with structures which may not have documented approval is also provided. Once property information is released, Council may receive numerous follow up calls/emails from both parties in the sale and/or their representatives to clarify information and assist with interpreting plans/consents etc.
